Hirschauer Reminds Residents of their Rights as Threat of Immigration Raids Looms

Batavia, Ill. – As communities brace for the threat of federal immigration raids, state Rep. Maura Hirschauer is encouraging residents to know their rights under Illinois state law intended to check unlawful harassment and racial profiling. 

“I care deeply about the safety and well-being of my constituents; and I will do all that I can to protect the hard-working people and families of the 49th district,” said Hirschauer. “The Trump Administration is threatening to target our immigrant communities here in Illinois with raids and deportation. As we move forward these next four years, it’s important that our immigrant communities know their rights, and my office is here to offer support. Illinoisans believe in taking care of their neighbors; it is the Midwest way, and it is now more important than ever.”

Rep. Hirschauer is reminding residents of their rights under Illinois state law, including the Illinois Trust Act and the VOICES Act, which protects all residents from warrantless arrest in a variety of safe spaces, including churches, schools, hospitals, and group homes. 

Additionally, immigrant-rights experts are reminding residents to:

  • Refuse to open the door to their home unless presented with a warrant signed by a judge. 
  • Exercise the right to remain silent and not answer questions. 
  • Do not sign anything without speaking to an attorney. 
  • If detained, get a lawyer trained in immigration law. Call the Illinois Coalition for Immigrant and Refugee Rights helpline at 1-855-435-7693 to connect with experts in immigration law.

Batavia, Ill. – Mientras las comunidades se preparan por las amenazas de incursiones de oficiales federales de inmigracion, el/la rep. estatal [name] motiva a sus residentes para reconocer sus derechos bajo la ley del estado de Illinois que intenta detener el acoso injustificado o la persecución racial.

CHICAGO, Ill. — As a long-time advocate for gun safety reform, state Rep. Maura Hirschauer, D-Batavia, participated in a hearing of the proposed assault weapons ban by the Judiciary – Criminal committee.

“Gun violence is a complex issue, and we cannot properly address it without hearing the input and experiences of survivors, the families of victims, health care professionals, and other stakeholders,” Hirschauer said. “Today we heard the stories of so many brave individuals who have lived through unspeakable tragedy. Their courage and honesty cannot be understated and will continually inspire my work to reduce gun violence and pass a ban on assault weapons and high capacity magazines.”

Hirschauer is a chief co-sponsor of House Bill 5855, also known as the Protect Illinois Communities Act. The proposal would ban assault weapons, large capacity magazines, and rapid-fire devices, strengthen firearm restraining order laws and hold gun manufacturers accountable for marketing firearms products using deceptive marketing tactics. The committee also passed House Joint Resolution 97, which mourns the lives lost in the Fourth of July shooting in Highland Park.

“Illinoisans have experienced too much gun violence, with impacts that go beyond the devastating loss of life or physical injury. Lingering trauma, from Chicago to East St. Louis to Aurora, destroys us from within. To force our constituents to endure these effects is negligent and reprehensible,” said Hirschauer. “Now is the time for Illinois’ leaders to set aside their differences and take concrete action to ban assault weapons and reduce the plague of gun violence that has been ravaging our communities.”

Hirschauer Bill Takes Trauma-Informed Approach to School Shooter Drills

 

Students and school personnel would receive advance notice of planned active shooter drills

under legislation introduced by state Rep. Maura Hirschauer, D-Batavia, aimed at preventing psychological impacts from these training simulations.

“It’s scary and heartbreaking that our reality necessitates preparing teachers and young children for how to respond if an attacker barges into their classroom with a gun,” said Hirschauer. “While there’s a need for law enforcement to train for real emergencies that we all hope never occur, drills that are overly realistic can be extremely traumatizing for children. My bill keeps the well-being of students and staff at the heart of school lockdown drills by taking a trauma-informed approach to these situations.”

Hirschauer, a longtime volunteer with Moms Demand Action, is sponsoring House Bill 2400 to address how lockdown drills affect children. The measure specifies that school shooter drills must be age and developmentally appropriate, include school-based mental health professionals and be announced in advance, with an option for parents and guardians to exempt their child from participating. Under current state law, schools and law enforcement agencies are required to conduct a lockdown drill within the first 90 days of the school year.

“We must continue to do everything in our power to protect students from the physical threat of school shootings, but we can’t jeopardize their mental health in the process,” said Hirschauer. “I am committed to removing the harmful impacts of active shooter drills and making sure they’re conducted in a more effective way.”

Reps Hirschauer and Stoneback visit Aurora to learn about NIBIN system

 

Today was an important day in the gun violence prevention movement.

For the first time in years, we heard our President declare gun violence a public health epidemic and outline a comprehensive plan of executive orders that will be crucial steps to curb gun violence across the country.

Here in the 49th District I am taking time to learn about and understand the multifaceted impacts of gun violence in our community. Today, alongside my colleague and sister GVP advocate, Representative Denyse Stoneback, I visited the Aurora Police Department to speak with local law enforcement and ATF representatives about the National Integrated Ballistics Information Network, or the NIBIN, system. 

We saw first hand how shell casings are collected, analyzed, and logged into the network. We heard accounts from officers in the major crimes task force of how leads generated from NIBIN reporting led to the arrest of straw purchasers in Indiana. Aurora PD runs a model NIBIN site that is used by police departments in the collar counties. Communities across Kane, DuPage, Grundy, Kendall, Lake, LaSalle, and Will counties benefit from the technology housed and stewarded by the Aurora Police Department.

Thank you to the Aurora Police Department for hosting us and sharing critical information with Rep Stoneback and our teams. The things we learned today will serve to shape our legislative priorities in the areas of gun violence prevention. Gun violence is a public health crisis, and we are committed to working together to keep our communities safe.
